A nurse may choose to complete more than one course in order to cover all content required in the rule. Forensic Evidence Collection CE: Effective September 1, 2013, nurses who perform a forensic exam on a sexual assault survivor must have completed basic forensic evidence collection training, or the equivalent education, prior to performing the examination [Board Rule 216.3(d)(1)]. This is a one-time requirement; therefore, nurses who perform forensic exams are encouraged to retain the certificate of course completion indefinitely. "Continuing education completed under this subsection shall include information relevant to forensic evidence collection and age or population-specific nursing interventions that may be required by other laws and/or are necessary in order to assure evidence collection that meets requirements under the Government Code §420.031 regarding use of a service-approved evidence collection kit and protocol. Content may also include, but is not limited to, documentation, history-taking skills, use of sexual assault kit, survivor symptoms, and emotional and psychological support interventions for victims." Effective September 1, 2005, the NPA was amended, adding the CE requirement, Forensic Evidence Collection in Continuing Education. This targeted CE requirement applies to all nurses practicing in emergency department (ED) settings as either their home unit, floating, contracted, or other duties that involve functioning in an ED setting or role. This is a one-time requirement per nurse effective September 1, 2006. Compliance with this requirement is ongoing for any nurse who begins practicing in an ED setting as there is no expiration date for this requirement under Texas Occupations Code § 301.306 (NPA).
